New resident of Louisiana, welcome to the community property regime! Louisiana Law provides for a community marital property regime which may affect a Louisiana divorce. Louisiana residents generally may opt out of this regime through a prenuptial agreement executed prior to their marriage. Exceptions to the community property regime that are agreed to after the marriage must be authorized by a court of law in most cases unless the parties have recently moved to Louisiana.
